General Terms

The UnCard Card Agreement (this “Agreement,” along with the General Terms, Fees Policy, Privacy Policy, and any other applicable terms and conditions) collectively form a legally binding agreement between you, the holder of the UnCard Card (the “Client”), and UnCard, a financial technology platform operating under the laws of the United States.

The Client acknowledges and agrees that by completing the application procedure, it indicates its intent to be bound by these terms and conditions, and that such completion shall constitute its execution of the agreement between the Client and UnCard.

Definitions

In this Agreement, the following terms have the meanings set out below:

  • “Issuer” means the licensed financial institution or electronic money institution that issues the UnCard Card under the applicable Visa or Mastercard program. The Issuer is a third party and is not UnCard.
  • “Service Provider” means the Issuer and/or any third-party partner engaged by UnCard to facilitate card issuance, payment processing, transaction settlement, or related financial services.
  • “UnCard” (also “we,” “us,” or “our”) means the UnCard platform, which operates as a program manager. UnCard is not a bank, electronic money institution, or card issuer. UnCard facilitates access to prepaid card products issued by its issuing partners.
  • “Card” or “UnCard Card” means the prepaid Visa or Mastercard card issued by the Issuer and distributed through the UnCard platform.

Eligibility

You must meet all of the following requirements to use the Service:

  • You are at least 18 years of age.
  • You are not a resident of a jurisdiction where the Service is prohibited by law.
  • You are not subject to any sanctions programs administered by OFAC, the UN, EU, or equivalent bodies.
  • You have the legal right to use the cryptocurrency you deposit.

Role of UnCard

UnCard operates as a program manager and technology platform. UnCard does not issue payment cards, hold Client funds in its own accounts, or act as a bank or electronic money institution. All cards are issued by the Issuer under the applicable Visa or Mastercard network rules. Certain restrictions, spending limits, and compliance requirements referenced in this Agreement may be imposed by the Issuer or the card network and are enforced by UnCard on their behalf.

Purpose

The UnCard Card is a prepaid card issued by the Issuer that supports users to directly top up USD amounts using USDT, ETH, BTC, SOL, XMR, LTC, and other supported cryptocurrencies. The Issuer reserves the right to amend the list of supported cryptocurrencies at any time without prior notice.

It can be used for online platforms globally that support Mastercard and Visa payments (such as Amazon, eBay, etc.), and can be linked to Apple Pay for offline payment scenarios.

Identity Verification (KYC)

KYC verification requirements depend on the card plan selected by the Client. Certain card plans may be issued without identity verification, while others require full KYC compliance before issuance or activation. The specific KYC requirements applicable to each card plan are disclosed during the application process and within the platform.

In cases of suspected fraud, suspicious activity, or chargebacks, UnCard reserves the right to close the associated card without prior notice, regardless of the card plan.

Fees and Charges

  • Mastercard and Visa enabled.
  • KYC requirements depend on the card plan.
  • Application fee depends on the card plan.
  • No monthly fee.
  • A recharge fee applies.
  • Monthly limits and recharge limits apply depending on the card plan.
  • Minimum recharge amount of 20 USD. The Issuer reserves the right to change this at any time without prior notice.
  • The UnCard Card is not a bank account and funds topped up through crypto bear no interest.

Fees applicable to card issuance, top-ups, and other transactions are displayed within the platform prior to confirmation. We reserve the right to modify our fee schedule with reasonable notice. Continued use of the Service after a fee change constitutes acceptance of the updated fees.

Account Registration

You must provide a valid email address to create an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must notify us immediately if you suspect unauthorized access. We reserve the right to terminate accounts that violate these Terms or applicable law.

Deposits, Balances, and Cards

Cryptocurrency deposits are converted to USD credits at the exchange rate determined at the time of processing. These credits are stored as a platform wallet balance and may be used to fund UnCard Cards. Balances are not insured by any government deposit protection scheme.

Cards are issued upon request subject to available balance and applicable plan requirements. Card spending limits, merchant category restrictions, and geographic availability are determined by our card-issuing partners and may change without notice.

When a virtual card is closed or expires, any remaining card balance is automatically returned to your platform wallet.

Withdrawal Procedure

  • Users have the ability to withdraw any unused balances within the card account using USDT.
  • The minimum amount that can be redeemed is 10 USD.
  • The shortest time interval allowed for redemption is 48 hours.

Use of UnCard

  • One user can only apply for one UnCard Card at a time. Additional slots for more cards may be purchased subject to availability and in accordance with the terms governing such purchases.
  • UnCard may set up and adjust, in its sole discretion, the maximum number of cards, the Monthly Limit, and the Card Limit for risk control and regulatory compliance purposes from time to time. Any payment exceeding such Monthly Limit shall be rejected.
  • All UnCard Cards remain the property of the Issuer and must be returned upon request. The Issuer or UnCard may cancel, revoke, repossess, or restrict the use of the UnCard Card at any time. UnCard may decline to authorize or reverse charges, or suspend the UnCard Card, for any reason including violation of this Agreement, suspected fraud, or creditworthiness. Neither UnCard nor the Issuer is responsible for losses resulting from declined or reversed transactions.
  • If UnCard determines that the Client’s card receives, or is likely to receive, a disproportionately high number of declined transactions, reversals, refunds, disputes, fees, or other liability, the Client may be subject to a handling fee upon notice via email. The Client agrees to terminate use of the Services if it does not agree to such fees or charges.
  • The card account is protected by a sophisticated bank-level security system, ensuring full protection of funds. Every time a user initiates a CVV or address information request, it undergoes secure verification. Users can also easily cancel their UnCard Card and return the balance to their own wallet. We do not recommend that users share their CVV code under any circumstances.
  • The Client shall be responsible for securing account credentials, UnCard Card numbers, and security features (including the CVV and PIN, if any). The Client shall be responsible for charges, fees, and penalties resulting from any failure to exercise reasonable care in safeguarding UnCard Cards from loss or theft, or failure to promptly report loss or theft. The Client understands that it is its responsibility to monitor any suspicious or unauthorized activities on the UnCard Card and that it is liable for unauthorized use to the fullest extent permitted by applicable law.

Card Cancellation Process

  • When a user initiates a card cancellation request, the system checks whether there is any balance in the account. If the balance is equal to or greater than 10 USD, the card cancellation refund process proceeds.
  • If there is no balance in the account, the user will receive a prompt to confirm the destruction of the UnCard Card.
  • If the balance in the account is less than 10 USD, the user will receive a prompt informing them that the balance is insufficient to be refunded, and will then be asked to confirm the cancellation.
  • During the cancellation refund process, the withdrawal amount will be fixed.

No Refund Policy

Due to the irreversible nature of cryptocurrency transactions, all deposits are final and non-refundable. We strongly recommend verifying all deposit amounts before confirming any transaction. In exceptional circumstances, refund requests may be reviewed at our sole discretion.

Prohibited Uses

You agree not to use the Service to:

  • Engage in money laundering, fraud, or any other illegal financial activity.
  • Purchase illegal goods or services.
  • Circumvent sanctions or export control regulations.
  • Violate any applicable local, national, or international law or regulation.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Attempt to gain unauthorized access to any part of the Service or its related systems.

We reserve the right to suspend or terminate accounts that violate these restrictions and to report suspected illegal activity to relevant authorities.

Intellectual Property

All content, trademarks, logos, and software comprising the Service are owned by or licensed to UnCard. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal or business purposes in accordance with these Terms. You may not reproduce, distribute, or create derivative works without our express written consent.

Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, UNCARD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING LOSSES DUE TO CRYPTOCURRENCY PRICE VOLATILITY, NETWORK FAILURES, OR UNAUTHORIZED ACCESS TO YOUR ACCOUNT.

Indemnification

You agree to indemnify and hold harmless UnCard, its officers, directors, employees, and partners from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, or your violation of any applicable law.

Changes to the Service and Terms

We reserve the right to modify or discontinue the Service, or any part thereof, at any time. We may also update these Terms periodically. Material changes will be communicated by updating the “Last updated” date above or by other means. Your continued use of the Service after any change constitutes your acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any disputes arising under or relating to these Terms shall be resolved through binding arbitration or in the courts of Hong Kong, as determined by us.

Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
